Hayley has a wide range of experience in the resolution of disputes in the offshore energy sectors, acting in LCIA and ICC arbitrations.

Within the offshore energy sector, Hayley acts for, amongst others, clients engaged in floating production, assisting on cases including conversion/refurbishment project disputes and FPSO operational disputes.

As well as contentious work, Hayley's experience includes non-contentious contract negotiation and drafting, including experience in negotiating and drafting EPC contracts in respect of upgrade works for FPSOs.

Expertise

  • Acting for an FPSO owner in LCIA arbitration proceedings relating to the substantial refit and refurbishment contract for the FPSO vessel (including issues such as termination rights, critical path delay, prolongation claims, the variations regime and scope of work).

    Advising an FPSO owner on ongoing issues with the chartering oil company arising out of maintenance of the FPSO and issues surrounding shutdown.

  • Advising Altera Infrastructure on the negotiation and drafting of an EPC contract with a joint venture between Aker Solutions and Drydocks World Dubai for the redeployment of the FPSO Knarr to the Rosebank field.

  • Acting for Charterers in respect of a claim brought by Owners of an offshore support vessel used to mobilise a drill used for offshore exploration projects. Owners' claim related to alleged unpaid hire, and Charterers' counterclaim related to termination of the charterparty.
